A New York court ruled in favor of Hermes in a trademark infringement suit by artist Mason Rothschild, who created NFT bags that resembled the model of the famous Birkin.

The artist was found guilty of trademark infringement, brand dilution and cybersquatting. Hermes will receive $110,000 for trademark infringement and brand dilution, as well as $23,000 in compensation for cybersquatting.

"Hermes is a house of creativity, craftsmanship and authenticity that has supported artists and freedom of expression since its founding. In this dispute, the House had to act to protect consumers and the integrity of its brand," said a brand spokesperson.

Rothschild attorney Rhett Millsaps said, "We will be filing an appeal. We will pursue every legal avenue available to us. This is a great day for big, luxury brands and a terrible day for all artists."

The Birkin bag NFT trial is the first case in the U.S. in which NFT has been tried through intellectual property law. The verdict could greatly affect the future activities of all NFT artists.
